Privacy policy

How LIFLOR processes the personal data entrusted to it through liflor.nc.

Introduction

This Privacy Policy sets out and informs you of the way in which LIFLOR uses and protects any personal data you may provide to us when you use the website accessible at the following URL: www.liflor.nc (hereinafter the “Site”).

It has been drawn up in accordance with French Law No. 78-17 of 6 January 1978 on information technology, data files and civil liberties, as amended (the “French Data Protection Act”), and with the General Data Protection Regulation (GDPR), as applicable in New Caledonia.

Please note that this Privacy Policy may be amended or supplemented at any time by LIFLOR, in particular in order to comply with any legislative, regulatory, case-law or technological development. In such a case, the date of the update will be clearly indicated at the top of this policy. Any such amendments are binding on the User as soon as they are published online; you are therefore invited to review this policy regularly in order to keep informed of any changes.

1. Identity of the Data Controller

The controller of the personal data collected on the Site is:

  • LIFLOR, a limited liability company (SARL) with a share capital of XPF 100,000;

The publication director of the Site is Mr Germain Wiwane. The Site was designed and built by Site Internet NC (siteinternet.nc) and is hosted in New Caledonia by Stratos NC (Pacific Consulting group) — see the section entitled “Hosting and Data Location” below.

2. Personal Data Collected

You may browse the Site without providing any personal information about yourself. The Site offers no customer account creation, no online sales and no newsletter subscription: no personal data is collected on the Site other than through the two forms described below.

LIFLOR collects personal data only when you voluntarily complete the contact form or the quote request form. The data collected in that case is the following:

  • Name;
  • Company;
  • Email address;
  • Message;
  • Country.

(hereinafter your “Personal Information”). You are under no obligation whatsoever to provide this information to LIFLOR; however, should you decline to do so, we will be unable to reply to your message or to prepare the quote you have requested. By providing this information, you expressly agree to its being processed by LIFLOR for the purposes set out below.

The emails generated by these forms are delivered by the technical service provider SendGrid (see the section entitled “Recipients and Processors”). LIFLOR carries out no profiling and no automated decision-making based on your data.

3. Purposes of Processing

LIFLOR processes your Personal Information exclusively:

  • to respond to the messages you send us through the contact form;
  • to process your quote requests and send you an appropriate proposal;
  • to follow up on the resulting correspondence.

Your data is used for no other purpose: LIFLOR carries out no commercial prospecting, sends no newsletters and engages in no profiling.

4. Legal Bases for Processing

The processing operations described above rely on the following legal bases:

  • Contact form: your consent, given by voluntarily submitting the form (Article 6(1)(a) GDPR);
  • Quote request form: the performance of pre-contractual steps taken at your request (Article 6(1)(b) GDPR).

You may withdraw your consent at any time, without affecting the lawfulness of processing carried out before such withdrawal, by contacting us using the details set out in the section entitled “Identity of the Data Controller”.

5. Recipients and Processors

LIFLOR is the sole recipient of your Personal Information. This information, whether in individual or aggregated form, is never sold, rented or transferred to third parties. Neither LIFLOR nor any of its processors commercialises the personal data of the Site's visitors.

For the technical operation of the Site, LIFLOR uses the following service providers, which access data only to the extent strictly necessary for the performance of their duties:

  • Stratos NC (Pacific Consulting group): hosting of the Site, on servers located in New Caledonia;
  • Site Internet NC (siteinternet.nc): design and technical maintenance of the Site;
  • SendGrid (Twilio Inc.): technical delivery of the emails sent from the Site's forms.

The use of SendGrid for email delivery may involve the transfer of the data contained in the forms to servers located outside New Caledonia and the European Union. This provider contractually frames its processing with appropriate safeguards as to the confidentiality, use and protection of data, in accordance with the applicable regulations. No other transfer of data outside New Caledonia takes place.

6. Data Retention

Your Personal Information is retained by LIFLOR only for as long as is necessary for the purpose for which it was collected — namely, the handling of your message or quote request and the follow-up of the resulting correspondence — and in any event for no longer than 24 months from our last exchange. At the end of this period, it is deleted.

7. Hosting and Data Location

The liflor.nc website is hosted in New Caledonia by Stratos NC (Pacific Consulting group). The data you submit through the Site is therefore processed on servers located in New Caledonia, with the sole exception of email delivery through SendGrid, as described in the section entitled “Recipients and Processors”.

8. Your Rights over Your Data

In accordance with the French Data Protection Act and the GDPR as applicable in New Caledonia, you have the following rights over your personal data.

a. Right of access to and disclosure of data

You may access the Personal Information relating to you and obtain a copy of it. In view of LIFLOR's duty of security and confidentiality in the processing of personal data, your request will be handled subject to proof of your identity. LIFLOR shall be entitled, where appropriate, to refuse manifestly excessive requests (by reason of their number or their repetitive or systematic nature).

b. Right to rectification

You may request the rectification, updating or completion of any data relating to you that proves to be inaccurate, erroneous, incomplete or out of date.

c. Right to erasure

You may request the erasure of your data, in particular where it is no longer necessary for the purposes for which it was collected or where you withdraw the consent on which the processing is based.

d. Right to object

You may object to the processing of your data on grounds relating to your particular situation. As LIFLOR carries out no commercial prospecting, your data is in any event never used for that purpose.

e. Right to data portability

You may ask to receive the personal data you have provided to us in a structured, commonly used and machine-readable format, and to transmit that data to another controller.

f. Other rights

You also have the right to request the restriction of the processing of your data, the right to withdraw your consent at any time, and the right to give instructions concerning the retention, erasure and disclosure of your personal data after your death.

Before responding to your request, we may need to verify your identity and/or ask you to provide further information. LIFLOR undertakes to respond to any request for access, rectification, erasure, objection or portability, or to any further request for information, within a reasonable period not exceeding one (1) month from receipt of your request.

9. Complaints to the Competent Authority (CNIL)

If, after contacting us, you consider that LIFLOR is not complying with its obligations regarding your Personal Information, you may lodge a complaint with the competent supervisory authority, the Commission nationale de l'informatique et des libertés (CNIL), in particular electronically at the following address: https://www.cnil.fr/fr/plaintes

10. Security

The personal information we collect is kept in a secure environment. Persons working for LIFLOR and for its processors are required to respect the confidentiality of your information. To ensure the security of your personal information, we rely in particular on the following measures:

  • encryption of exchanges between your browser and the Site using the HTTPS protocol (SSL/TLS);
  • hosting of the Site in New Caledonia with a professional hosting provider (Stratos NC);
  • restriction of access to the data to those persons with a need to know.

However, as no mechanism offers absolute security, a degree of risk is always present when using the Internet to transmit personal information.

11. Minors

The Site is not directed at minors, and LIFLOR does not knowingly collect personal data relating to them. If you hold parental authority and believe that a minor has provided us with personal data through one of the Site's forms, you may contact us using the details above to request its erasure.

12. Cookies, Trackers and Third-Party Content

The Site uses no audience measurement tool and no advertising or marketing cookies. Your cookie choices (the “necessary”, “statistics” and “marketing” categories) are stored locally in your browser, in local storage (localStorage), under the key liflor_cookie_preferences; this information remains on your device and is not transmitted to LIFLOR.

The Site's contact page embeds an OpenStreetMap map by means of an iframe: displaying this map causes content to be loaded from OpenStreetMap's servers, which is subject to that third party's privacy policy. The Site's fonts are self-hosted: no request is sent to any remote font service (such as Google Fonts).

More generally, the use of links or content pointing to third-party websites is subject to those websites' own privacy policies, for which LIFLOR cannot be held responsible and with which we invite you to familiarise yourself.

13. Changes to this Policy

LIFLOR reserves the right to amend this Privacy Policy at any time, in particular to reflect changes in the applicable laws and regulations or in the processing carried out on the Site. Any amendment takes effect as soon as it is published online, and the update date shown below is revised accordingly. We invite you to review this page regularly.
